Appeals at Land Between Bypass and the Rear of 109 to 247 Mansfield Road, Hasland, Chesterfield by Persimmon Homes Nottingham and Hallam Land Management

Persimmon Homes Nottingham and Hallam Land Management have submitted appeals against North East Derbyshire District Council’s refusal of the following proposals on land Between Bypass and the Rear of 109 to 247 Mansfield Road, Hasland, Chesterfield:

  • Application for approval of reserved matters (all matters except access) for residential development of up to 160 dwellings (including necessary infrastructure and public open space); and
  • Full planning application for proposed residential development of 160 dwellings (including infrastructure and public open space).

The first application related to the approval of reserved matters (all matters except access) for residential development of up to 160 dwellings which was refused at planning committee on 4 April 2017 (16/00888/RM). The second application was a full planning application for residential development of 160 dwellings which was refused at planning committee on 21 November 2017 (17/00806/FL). Planning appeals against both decisions have subsequently been submitted by the applicant.

The recently refused Full Application was prepared by the Appellants with a view to addressing the Council’s concerns in respect of the Reserved Matters layout and therefore avoiding requirement, time and costs associated with an appeal against the Reserved Matters refusal. The Revised Layout Plan put forward with the Full application was a result of detailed discussions with the Council’s Officers and it is believed that of the two layouts, the one submitted with the Full Application was preferred by the majority of residents, as it more closely mirrored the illustrative plan submitted with the 2014 Outline Application.

The planning appeals were registered as valid on 7 February 2018 and it has been confirmed by the Planning Inspectorate that both appeals will be heard at a conjoined Public Inquiry on a date to be confirmed.

Following discussions with North East Derbyshire District Council the Appellants have decided to ask the appointed Planning Inspector to only consider the Revised Layout Plan and substitute the Reserved Matters layout plan 01 – PL/WIN/01 Revision K with the layout submitted in relation to the Full Application Appeal.

This layout substitution should simplify matters during the Public Inquiry and save time and costs for all parties concerned.

Thus in summary, the Appellants wishes the Revised Layout Plan to be considered in relation to both the Reserved Matters Appeal (APP/R1038/W/17/3182428); and in relation to the Full Application Appeal (APP/R1038/W/17/3190910).

The proposed Plan substitution is made without prejudice to the Appellants position that the originally submitted Reserved Matters and Full Application schemes are appropriate.
